I hereby certify that the statements made regarding my experience to be correct and acknowledge that I understand that my acceptance on this trip is predicated on my assurance that I am physically fit to engage in ocean SCUBA diving, that I fully understand the risks involved, and I am fully prepared to assume such risks.
It is understood that UnderSea is independent of, and has no business association, partners, joint ventures, owners or otherwise with any resorts, hotels, carriers, boat operators or other persons or firms furnishing any service or facility in connection with the above referenced travel program.
It is expressly understood and agreed that UnderSea will assume no responsibility or liability for service, transportation or equipment made available by any resort, hotel, boat, or other person or entity, either as to its availability or as to its safety, quality or condition, nor for the acts of any employee or agent of any such establishment, firm, person or entity. It is also understood and agreed that UnderSea does not, by acceptance of this application, assume any responsibility or liability for the safety of any participating individual, particularly while such individual is engaged in underwater activities, whether alone or in groups, under the supervision of tour escort or otherwise.
SCUBA instruction will be available at some locations independent of UnderSea What We See Inc., which does not assume any responsibility for course content and/or safety.
The undersigned further agrees that in consideration of the price at which the said program is offered and conducted and other good and valuable considerations, and in order to induce UnderSea to accept the applicant as a member of such a program, the applicant or the undersigned parent or guardian of the applicant under the age of maturity, releases and absolves UnderSea, and agents and employees thereof from any and all liability for property loss, or damage, and/or from any and all damages resulting from death, or personal injuries including loss of services, which I may sustain on account of, arising out of, or in conjunction with said program, either resulting from negligence of any in charge or participating in said program, or from the ownership, maintenance, use, operation or control of any automobile, shop, airplane, bicycle, boat, vehicle, inn, hotel, common carrier or otherwise.
It is further understood and agreed that prevailing weather conditions, changes in local government regulations, customs, and the remoteness of the area may cause minor inconvenience, substitution of equipment and/or facilities or modification to the diving portions of the program itinerary. UnderSea reserves the right to modify and/or cancel diving and other arrangements due to adverse weather conditions and to substitution of equipment and/or facilities. No refunds can be made for cancelled diving and other arrangements due to adverse weather conditions, equipment failure, minor inconvenience or substitutions of equipment and/or facilities.
All activities that are available during your trip carry with them various inherent risks. Although all possible precautions will be taken to guard against such dangers, it is understood that your safety cannot be guaranteed. Should you decide to participate in such activities during your trip, it is understood that it will be at your own risk and that UnderSea will assume no responsibility for your safety.
Undersea recognizes that our travels take us to some beautiful, yet troubled parts of the world. Working with qualified and experienced experts and leaders at each location, Undersea does its best to ensure client safety. However, it is understood that your travel safety cannot be guaranteed and that all travel will be undertaken at your own risk.
The agreement signed by applicant and by parent or guardian of any minor applicant is in all respects subject to the terms and conditions described above, which have been read and unconditionally agreed to. I further agree to observe strictly and comply with such additional reasonable terms and regulations as UnderSea may from time to time deem necessary or desirable to prescribe during the course of the program.
